Planning and Development Committee Meeting

THAT the agenda for the Planning & Development Committee meeting of May 15, 2024 be confirmed.

THAT item 4.3 as listed on the agenda be approved by consent.

THAT at the request of the applicant report DS-22-2024 of the Development Services department dated May 15, 2024 regarding Zoning By-Law Amendment File No. Z4-24 be referred to staff to provide an update subject to the applicant's new and/or revised application(s) after further examination of a potential real estate transaction.

1. THAT report DS-24-2024 of Development Services dated May 15, 2024 regarding Consent & Rezoning File Nos.: B3-24 & Z5-24 be received; 2. THAT Consent & Rezoning File Nos.: B3-24 & Z5-24, for lands located at 1400 County Road 12, in the Ward of Hallowell, be approved subject to the following conditions: 1. THAT each condition shall be fulfilled no later than two years from the date of mailing of the decision; 2. Approved Rezoning, with all means for appeal exhausted, of the subject lands; 3. The County may not have clear title to the lands on County Road 12 that abuts the subject lands including in this proposal. The applicant will be responsible for all costs to provide clear title to the lands for the subject road allowances to the County, including any additional width needed to accommodate the existing travelled roads, shoulders and drainage works, all to the satisfaction of the Director of Development Services; 4. Road widening or confirmation thereof for the provision of 13 meters (43 feet) of road allowance along County Road 12 clear of encumbrances, building, structures, and fencing from the centerline of the travelled portion across the frontage of the severed and retained parcels in this proposal to the satisfaction of the Director of Development Services; 5. Confirmation from the applicant’s solicitor that the properties severed by Consent File No. B3-24 and the corresponding benefiting lands will merge on title; 6. THAT the items approved under Delegated Authority By-Law 98-2020, as amended be received for information.
